This year's Brocklesby case seems to extend the time limits set down by the Limitation Act 1980 and could have dire consequences for the insurance industry.[QQ]
"Justice delayed is justice denied." No one should have to endure apotential court claim hanging over them for years after any alleged
wrongdoing. The Limitation Act 1980 aims to ensure this does not
happen.
A negligence claim cannot usually be brought over six years after the date
when any loss occurred (the general 'time bar'). Someone can bring a claim
within three years of discovering their loss if they were unaware of it at
the time it was caused (the 'latent damage' time bar). A claim cannot
