If the ban on referral fees goes ahead next year, the repercussions could 
be felt throughout the industry, explains Tony Cornell

The Legal Aid, Sentencing and Punishment of Offenders Bill is passing through Parliament and is likely to come into force in October next year. It changes the legal framework enormously and is the biggest change since legal aid for personal injury cases was abolished in 2000. Broadly it appears to:

* prohibit the use of referral fees between any regulated entities, eg. solicitors, brokers, etc;

* make after the event premiums no longer recoverable in addition to damages;

* make the plaintiff pay
