Risk management/claims: Brokers warned: enforce EL or risk legal action
Brokers that fail to advise clients about environmental liability risks could face legal action following a government crackdown.
Simon White, environmental branch manager at XL Insurance, said local authorities were finally getting to grips with Environmental Damage (Prevention and Remediation) Regulations 2009 but that the insurance industry was still unsure of the limitations of public liability (PL) policies in relation to environmental liability claims.
