ECJ ruling will only apply to new contracts
The Treasury has confirmed the ban on the use of gender in underwriting will not affect policies taken out before 21 December 2012.
In March this year the European Court of Justice ruled that discriminating by gender will be unlawful for calculating insurance premiums. However it was unclear if the ruling would apply to contracts that were already in place.
In a written ministerial statement today, financial secretary, Mark Hoban said: "The government's view is that the judgment only applies to new contracts for insurance and related financial services entered into on or after 21 December 2012.
