The House of Lords has dismissed Norwich Union's appeal on both
conditional fee agreement success and after-the-event insurance premiums
in the case of Callery v Gray. The decision was taken with a majority of
four to one.


The decision upholds the Court of Appeal's ruling that after-the-event
premiums are recoverable in principal. For a simple rear-end shunt, as in
this case, a 20% success fee has been deemed appropriate.
